⚠️ Important notice — please read before use. By using this app, you acknowledge that you have read, understood, and agreed to the following terms and conditions.

This app is provided by Warwick Aubin, trading as SMSF Cockpit (a registered business name, ABN 64 799 581 029). In these terms, "the creator" means Warwick Aubin trading as SMSF Cockpit.

1. No financial or legal advice

This app is an information-management and educational tool designed to assist SMSF trustees with compliance tracking and record-keeping: deadlines, nominations, contributions, pensions, trustee decisions and audit preparation. It does not constitute financial, investment, legal, or tax advice.

The creator is not a licensed financial adviser, accountant, or registered tax agent under the Tax Agent Services Act 2009 (Cth). Nothing in this app, including its status flags, warnings, readiness checks, reminders, or any calculated outputs, constitutes financial product advice, tax advice, legal advice, or a recommendation to acquire, hold, or dispose of any financial product.

Before making any decision about superannuation, pensions, investments, or asset allocation, you should seek advice from a licensed financial adviser and/or a qualified accountant, tax agent, or SMSF specialist who can consider your personal circumstances.

2. "As-is" and no warranties

While every effort has been made to ensure the accuracy and integrity of the calculations within this app, the service is provided on an "AS-IS" and "AS-AVAILABLE" basis, with all faults.

The creator makes NO WARRANTIES, express or implied, regarding:

  • The accuracy, completeness, or reliability of any calculations or data generated
  • The fitness for a particular purpose of the app or its outputs
  • The absence of errors, bugs, or defects in the calculations or logic
  • The continuous availability of the service

All figures, statuses, and outputs depend entirely on the assumptions and data you input. Accuracy is not guaranteed, and you should independently verify all figures before relying on them. Deadlines and thresholds shown are typical ATO timeframes and may change.

3. Trustee responsibility and verification

Under Australian law, SMSF trustees bear ultimate legal and financial responsibility for:

  • The compliance of their fund with the Superannuation Industry (Supervision) Act 1993 (SIS Act)
  • The fund's investment strategy and its implementation
  • The accuracy of all reporting to the Australian Taxation Office (ATO)
  • Meeting all contribution caps, pension minimum drawdown requirements, and other regulatory obligations

This responsibility CANNOT be delegated or outsourced to any software tool, including this app.

Users MUST independently verify all calculations, compliance statuses, and outputs against:

  • Original source data (bank statements, broker reports, bond confirmations)
  • Official ATO guidelines and current legislative thresholds
  • Advice from qualified professionals (accountants, auditors, financial advisers)

before making any investment decisions, executing transactions, or lodging official returns.

4. Limitation of liability

To the maximum extent permitted by law, the creator shall NOT be liable for any:

  • DIRECT DAMAGES, including but not limited to investment losses resulting from reliance on calculations
  • INDIRECT DAMAGES, including consequential losses, loss of opportunity, or economic loss
  • TAX PENALTIES, including ATO administrative penalties, shortfall interest charges, or audit costs
  • COMPLIANCE FAILURES, including breaches of contribution caps, pension minimums, or other SIS Act requirements
  • LOST PROFITS, whether arising from investment decisions or operational disruptions
  • DATA LOSS, resulting from service interruption, errors, or software incompatibility

arising out of the use, misuse, or inability to use this app.

LIABILITY CAP: In any event where liability is found to exist despite this disclaimer, the total aggregate liability of the creator shall be strictly limited to the amount actually paid by the user for access to this app.

5. Your data and entries

The app's outputs depend on what you enter. The user acknowledges that:

  • Incorrect, incomplete, or out-of-date entries (including the reference date, dates of birth, balances, and contribution and pension figures) will produce incorrect statuses and warnings
  • Editing or deleting entries changes the results
  • The creator cannot be held responsible for errors resulting from the data entered by users
  • You are responsible for keeping your own copies of records that matter to you (the Succession Plan and Annual Audit Checklist can be exported)

If you suspect an error or unexpected behaviour, compare outputs against your original source documents before taking any action based on the app's results.

6. Intellectual property and licence

This app and all its contents, including software, structure, documentation, and design, are protected by copyright and intellectual property laws.

Access is granted personally to the individual named as "Licensed to" above. It is non-transferable: your account cannot be sold, gifted, sub-licensed, or passed on to another person or organisation, whether for payment or free of charge. Each person should use their own login.

Your licence permits:

  • Personal use for managing your own SMSF
  • Use on devices you own or control

Your licence does NOT permit:

  • Redistribution, resale, or sharing with third parties, including sharing your login
  • Commercial use (providing services to others using this tool)
  • Reverse engineering, decompiling, or extracting the software or its logic for use in other products
  • Removing or altering copyright notices, disclaimers, or licence information

Unauthorised copying, distribution, or commercial exploitation is strictly prohibited and may result in legal action.

7. Governing law

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Australia. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts of Australia.

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
